These Terms of Service (“Terms”) govern your access to and use of the Churchday platform, website, and related services (collectively, the “Service”). Churchday is operated by Zion Design, LLC, a New Jersey limited liability company doing business as Churchday (“Churchday,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Description of Service
Churchday is a church management platform that provides tools for event management, people and member tracking, email communication, team scheduling, and related analytics. The Service is designed for churches, religious organizations, and nonprofit communities to manage their operations and engage their congregations.
2. Account Terms
- You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
- You must provide accurate and complete information when creating your account and keep it updated.
- You are responsible for maintaining the confidentiality of your account credentials, including your password.
- You are responsible for all activity that occurs under your account, whether or not authorized by you.
- You must notify us immediately at support@churchday.co if you become aware of any unauthorized access to your account.
- One person or organization may maintain multiple accounts for separate churches or organizations, but a single account cannot be shared among multiple organizations.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service for any purpose that is illegal or prohibited by these Terms.
- Send unsolicited bulk emails (spam) through the Service's communication tools.
- Upload or transmit viruses, malware, or other harmful code.
- Attempt to gain unauthorized access to any part of the Service, other accounts, or related systems.
- Use the Service to store or transmit content that is defamatory, obscene, or that infringes on the rights of others.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse-engineer, decompile, or disassemble any portion of the Service.
- Use the Service to collect personal information about individuals without their knowledge or consent.
- Resell, sublicense, or make the Service available to third parties outside your organization without our written consent.
4. Data Ownership and Your Content
- Your Data: You retain all rights to the data you enter into the Service, including member information, event data, attendance records, and communications (“Your Content”). We do not claim ownership of Your Content.
- License to Us: By using the Service, you grant us a limited, non-exclusive license to host, store, process, and display Your Content solely for the purpose of providing and improving the Service.
- Data Export: You may export Your Content at any time in commonly used formats. We will provide reasonable assistance for data migration upon request.
- Data Responsibility: You are responsible for the accuracy of the data you enter and for obtaining appropriate consent from individuals whose personal information you store in the Service, in compliance with applicable privacy laws.
- Backup: While we maintain regular backups of the Service, you are encouraged to maintain your own backups of Your Content.
5. Payment Terms
Churchday currently offers a free tier of service. If we introduce paid plans in the future:
- Pricing will be clearly communicated before any charges apply.
- You will not be charged without your explicit consent.
- Existing free-tier users will receive advance notice of at least 30 days before any changes to their plan or pricing.
- All fees are exclusive of applicable taxes unless stated otherwise.
- Payment terms, including billing cycles, refund policies, and cancellation procedures, will be detailed at the time paid plans are introduced.
6. Intellectual Property
The Service, including its design, features, code, documentation, logos, and trademarks, is owned by Churchday and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse-engineer or attempt to extract the source code, unless applicable law permits it or you have our written permission.
7. Privacy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to the terms of our Privacy Policy.
8. Email Communication
The Service includes email campaign features that allow churches to communicate with their members. You agree to comply with all applicable email laws, including CAN-SPAM, CASL, and GDPR. You represent that you have appropriate consent from recipients before sending email through the Service. We reserve the right to suspend email sending privileges if we detect abuse or excessive bounce/complaint rates.
9. SMS / Text Messaging
The Service includes SMS and MMS text messaging features that allow churches to send event invitations, reminders, schedule notifications, and other communications to their members. When you use these features, you represent and agree to the following:
- Consent: You will obtain prior express consent from every recipient before adding them to a Churchday SMS program, unless the recipient has already provided their phone number to your church for church communications and implied consent is permitted under the Telephone Consumer Protection Act (TCPA) or applicable nonprofit exemptions. Where explicit consent is required, you will use the opt-in mechanisms Churchday provides and will not pre-check consent boxes or bundle SMS consent with acceptance of unrelated terms.
- Consent records: Churchday automatically records the date, time, source, and language of each consent. You authorize Churchday to maintain these records on your behalf for as long as required by law and carrier requirements.
- Content restrictions: You will not use the Service to send messages containing prohibited content, including (without limitation): sexually explicit content; hate speech; content promoting or referencing alcohol, cannabis, tobacco, firearms, or gambling; high-risk financial products (payday loans, debt collection, cryptocurrency promotion); content that violates CTIA Messaging Principles and Best Practices; content prohibited under Churchday’s brand and carrier registrations; or any unlawful content. You will not use the Service for solicitation or purposes outside the scope of a church’s religious or nonprofit mission.
- Opt-outs: Churchday automatically honors standard opt-out keywords (STOP, UNSUBSCRIBE, CANCEL, END, QUIT) and suppresses future messages to opted-out numbers. You will not attempt to bypass, disable, or override these opt-out mechanisms. You will not re-contact an opted-out recipient through a different number or platform without obtaining new express consent.
- Identification: All messages sent through the Service will identify Churchday or your church as the sender in the message body. You will not impersonate another organization, disguise the origin of a message, or misrepresent the purpose of a message.
- A2P sender of record: You acknowledge that Churchday is registered as the application-to-person (A2P) messaging sender of record with The Campaign Registry, U.S. mobile carriers, and other regulatory bodies, and that all messages sent through the Service must comply with the approved Churchday brand and campaign registrations.
- Recipient fees: Message and data rates may apply to recipients. Churchday does not charge recipients to receive messages but cannot waive, discount, or reimburse carrier fees charged by recipients’ mobile carriers.
- Suspension for abuse: Churchday reserves the right to suspend, throttle, or terminate SMS sending privileges (in whole or in part) if we detect abuse, non-compliant content, high opt-out rates, high complaint rates, carrier filtering, or any other condition that puts the Churchday brand, our messaging registrations, or other customers at risk.
- Indemnification for misuse: In addition to the general indemnification in Section 12, you agree to indemnify Churchday against any claims, fines, or carrier penalties arising from your misuse of the SMS features, including sending messages without required consent or sending prohibited content.

10. Service Availability and Modifications
- We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
- We reserve the right to modify, suspend, or discontinue any part of the Service at any time. For material changes that negatively affect your use, we will provide reasonable advance notice.
- We may release new features, updates, and improvements to the Service at our discretion.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.
- In no event shall Churchday, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
- Our total aggregate liability for any claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred US dollars ($100).
12. Indemnification
You agree to indemnify and hold harmless Churchday and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
13. Termination
- You may terminate your account at any time by contacting us or using the account deletion feature within the Service.
- We may suspend or terminate your account if you violate these Terms, engage in harmful conduct, or if required by law.
- Upon termination, your right to use the Service will cease immediately. We will retain Your Content for 30 days to allow you to export your data, after which it will be deleted in accordance with our Privacy Policy.
- Provisions of these Terms that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnification, and limitation of liability.
14. Dispute Resolution
Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the state of California, United States. Each party shall bear its own costs, and the arbitrator's decision shall be final and binding.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of laws principles.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the “Last updated” date. For significant changes, we will provide additional notice via email or an in-app notification at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service.
17. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Churchday regarding the Service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.
- Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
- Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, acts of government, or internet disruptions.
